TERMS OF SERVICE

1.1 Membership Agreement: By purchasing a membership or day pass, you enter into a binding agreement with ONE Gym. Membership terms, pricing, and access privileges are as specified at the time of purchase.

1.2 Membership Types: We offer various membership options including Day Pass, Week Pass, Month Pass, Quarter Pass, 6 Month Pass, and Annual Pass. Each membership type has specific terms, access rights, and pricing as detailed in our membership plans.

1.3 Service Access: Your membership grants you access to our facilities including the gym floor, locker rooms, recovery zones, café, and other amenities as specified in your membership plan. Access to certain premium services may require additional fees.

1.4 Membership Validity: Memberships are valid for the duration specified at purchase. Day passes are valid for a single day, while other memberships are valid for their respective periods from the activation date.

2.1 Code of Conduct: All members and guests must conduct themselves in a respectful, professional manner. We maintain a luxury environment and expect all users to respect the facility, equipment, staff, and other members.

2.2 Safety Requirements: You must follow all safety guidelines, use equipment properly, and seek assistance from our certified trainers when needed. ONE Gym is not responsible for injuries resulting from improper equipment use or failure to follow safety instructions.

2.3 Age Requirements: Members must be at least 16 years of age. Minors between 16-18 years require parental consent and supervision. Children under 16 are not permitted in the training areas.

2.4 Equipment Usage: All equipment must be used as intended and returned to its proper location after use. Members are responsible for any damage caused by misuse or negligence.

2.5 Personal Belongings: ONE Gym provides locker facilities, but we are not responsible for lost, stolen, or damaged personal belongings. Please secure your valuables appropriately.

2.6 Prohibited Activities: Smoking, alcohol consumption, drug use, photography/videography without permission, and disruptive behavior are strictly prohibited. Violations may result in immediate membership termination.

3.1 Payment Obligations: All membership fees, service charges, and additional services must be paid in full as specified at the time of purchase. Payment methods accepted include cash, credit/debit cards, and digital payment platforms.

3.2 Pricing: All prices are in Indian Rupees (INR) and are subject to change. Current pricing is displayed at the time of purchase. We reserve the right to modify pricing with advance notice to existing members.

3.3 Additional Services: Services such as personal training, salon services, café purchases, and recovery treatments are charged separately as per our service pricing. These charges are in addition to membership fees.

3.4 Payment Failure: Failure to make timely payments may result in suspension or termination of membership and access to facilities.

4.1 Cancellation Policy: Please refer to our separate Cancellation Policy for detailed terms regarding membership cancellations, refunds, and related procedures.

4.2 No Refunds for Used Services: Day passes and single-use services are non-refundable once used. Unused services may be eligible for refunds as per our Cancellation Policy.

4.3 Membership Freeze: Subject to our policies, memberships may be frozen for medical reasons or extended travel with prior written notice and approval. Freeze periods may be subject to administrative fees.

5.1 Health Declaration: By using our facilities, you represent that you are in good physical condition and have no medical conditions that would prevent safe participation in fitness activities.

5.2 Medical Consultation: We recommend consulting with a healthcare provider before beginning any new fitness program, especially if you have pre-existing medical conditions.

5.3 Assumption of Risk: You acknowledge that participation in fitness activities involves inherent risks. You voluntarily assume all risks associated with your use of our facilities and services.

5.4 Limitation of Liability: ONE Gym, its owners, employees, and trainers are not liable for any injuries, damages, or losses resulting from your use of our facilities, except where caused by our gross negligence.

6.1 Personal Training: Personal training sessions are provided by certified professionals. Sessions must be scheduled in advance and are subject to trainer availability. Cancellation policies apply as specified at booking.

6.2 Service Availability: While we strive to maintain all services, we reserve the right to modify, suspend, or discontinue any service, facility, or equipment with or without notice.

6.3 Third-Party Services: Services provided by third parties (such as salon services, café, etc.) may have separate terms and conditions. ONE Gym is not responsible for third-party service quality or disputes.

7.1 Ownership: All content, logos, trademarks, and intellectual property on our website and in our facilities are owned by ONE Gym or our licensors. Unauthorized use is prohibited.

7.2 Photography and Media: Photography and videography in our facilities require prior written permission. ONE Gym may use images or videos of members for promotional purposes unless you opt out in writing.

8.1 Privacy Policy: Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

9.1 Changes: We reserve the right to modify these Terms at any time. Material changes will be communicated to members via email or posted notices. Continued use of our services after changes constitutes acceptance.

9.2 Notice: We will provide reasonable notice of significant changes, typically 30 days in advance for existing members.

10.1 Termination by ONE Gym: We reserve the right to suspend or terminate your membership immediately for violation of these Terms, facility rules, or for any conduct we deem inappropriate or harmful to our community.

10.2 Termination by Member: Members may terminate their membership as per our Cancellation Policy. Termination does not relieve you of outstanding payment obligations.

11.1 Jurisdiction: These Terms are governed by the laws of India and the state of Maharashtra. Any disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.

11.2 Dispute Resolution: We encourage resolution of disputes through direct communication. If disputes cannot be resolved, they shall be addressed through appropriate legal channels in Mumbai.
